1. Overview
Transcend Technologies, Inc., doing business as iSocialize ("Company," "we," "us," or "our"), operates a peer-to-peer marketplace within the iSocialize application ("App") where users can list and purchase products from one another. The Company is NOT the seller of any products listed on the marketplace. We act solely as a platform facilitating transactions between buyers and sellers.
2. Buyer and Seller Responsibility
All transactions on the iSocialize marketplace are conducted directly between buyers and sellers. The buyer and seller are solely responsible for the terms of each transaction, including product condition, description accuracy, shipping, delivery, returns, and refunds. By using the marketplace, both buyers and sellers acknowledge and agree that the Company is not a party to any transaction and has no obligation to mediate, resolve, or adjudicate disputes.
3. Returns & Refunds Between Users
We strongly encourage sellers to clearly state their return and refund policies in their product listings. If a seller does not specify a return policy, the following default guidelines apply: • Return Window: Buyers may request a return within 7 days of receiving the item. • Condition: Items must be returned in the same condition as received. • Shipping Costs: Return shipping costs are the responsibility of the buyer unless the item was materially misrepresented. • Refund Processing: Sellers should process refunds within 5 business days of receiving the returned item. These guidelines are recommendations. The Company does not guarantee or enforce returns or refunds between users.
4. Disputes Between Buyers and Sellers
If a dispute arises between a buyer and seller, we encourage both parties to communicate directly and resolve the matter amicably. While the Company may, at its sole discretion, provide limited assistance in facilitating communication between parties, we are under no obligation to do so. The Company shall not be held liable for any losses, damages, or disputes arising from marketplace transactions.
5. Prohibited Items & Fraudulent Listings
Sellers must not list prohibited, illegal, counterfeit, or misrepresented items. The Company reserves the right to remove listings and suspend or terminate accounts that violate our Terms of Service. If you believe a listing is fraudulent or violates our policies, please report it through the App or contact us.
6. In-App Purchases & Virtual Currency
Purchases of virtual currency ("Coins"), in-app features, or digital goods made directly from the Company (not through the marketplace) are final and non-refundable, except as required by applicable law or the refund policies of the Apple App Store or Google Play Store. To request a refund for an in-app purchase, please contact the applicable app store directly.
7. Limitation of Liability
THE COMPANY IS NOT RESPONSIBLE FOR AND SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE, CLAIM, OR EXPENSE ARISING FROM OR RELATED TO ANY MARKETPLACE TRANSACTION, INCLUDING BUT NOT LIMITED TO: PRODUCT QUALITY, SAFETY, OR LEGALITY; ACCURACY OF PRODUCT LISTINGS OR DESCRIPTIONS; THE ABILITY OF SELLERS TO SELL OR BUYERS TO PAY; OR ANY SHIPPING, DELIVERY, OR RETURN ISSUES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRANSCEND TECHNOLOGIES, INC. DISCLAIMS ALL LIABILITY FOR MARKETPLACE TRANSACTIONS.
8. Chargebacks & Payment Disputes
If you initiated payment through a third-party payment processor (such as Stripe), you may have chargeback rights through your payment provider. However, filing a fraudulent or unjustified chargeback may result in suspension or termination of your account.
9. Changes to This Policy
We reserve the right to modify this Return & Refund Policy at any time. Changes will be posted in the App with an updated effective date. Your continued use of the marketplace constitutes acceptance of any changes.
